Cheque Bounce Procedure (Section 138 NI Act)
Under Section 138 of the Negotiable Instruments Act, 1881, the dishonor of a cheque for insufficiency of funds is a criminal offense. The statute enforces strict chronological deadlines (the 30-15-30 rule). Missing any of these mandatory deadlines can render a complaint legally void.

Anatomy of a Sec 138 Proceeding
Dishonor of Cheque
The cheque is presented to the bank within its validity (3 months). It is returned unpaid with a return memo stating reasons like "Funds Insufficient" or "Account Closed".
Dispatch of Statutory Demand Notice
A formal legal notice must be drafted by an Advocate and dispatched to the drawer within 30 days of receiving the bank memo, demanding the cheque amount.
15-Day Grace Period
Upon receipt of the notice, the drawer is granted a statutory period of 15 days to make the payment. No legal action can be initiated during this window.
Filing of Criminal Complaint
If the drawer fails to pay, the cause of action arises. A criminal complaint must be filed before the competent Magistrate within 30 days from the expiry of the grace period.
Pre-Summoning & Issuance of Process
The complainant records pre-summoning evidence via affidavit. If the Magistrate finds prima facie merit, summons are issued to the accused.
Trial & Cross-Examination
The accused appears, secures bail, and framing of notice occurs. This is followed by complainant evidence, statement of accused (Sec 313 CrPC), defense evidence, and final arguments.
Judgment
The court pronounces acquittal or conviction. Conviction can carry imprisonment up to 2 years and/or a fine extending up to twice the cheque amount.
