Anatomy of a Consumer Dispute

1. Occurrence of Deficiency/Defect

Unfair trade practice, defect in goods, or deficiency in services arises. This triggers the cause of action.

2. Dispatch of Legal Notice

While not strictly mandatory under the Act, sending a formal legal notice granting 15-30 days to resolve the grievance establishes bona fides and often leads to pre-litigation settlement.

3. Drafting & Filing (E-Daakhil)

Drafting the formal complaint with an index, affidavit, and annexures. Filing is now streamlined digitally via the E-Daakhil portal based on pecuniary and territorial jurisdiction.

4. Admission & Issuance of Notice

The Commission reviews the complaint for maintainability. Once admitted, formal notice is issued to the Opposite Party (OP).

5. Filing of Written Version (Strict Deadline)

The OP must file their defense within 30 days of receiving notice (extendable by 15 days maximum). Supreme Court strictly prohibits extensions beyond 45 days (New India Assurance v. Hilli Multipurpose).

6. Evidence by way of Affidavit

Both parties submit their evidence through sworn affidavits rather than oral testimony, ensuring expedited disposal.

7. Final Arguments & Order

Counsel for both sides advance final arguments. The Commission reserves the matter and pronounces the final order granting relief/compensation.
