Default Bail Timeline

Sec 187(3) BNSS

Calculates the 60 or 90-day expiry threshold. The right to statutory (default) bail accrues immediately if the investigating agency fails to file the chargesheet within this timeframe.

Undertrial Release Threshold

Sec 479 BNSS

Replaces Sec 436A CrPC. First-time offenders are now eligible for mandatory release on bond after serving just 1/3rd of the maximum sentence for the offense. General undertrials require 1/2.

Anticipatory Bail (Sec 482 BNSS)

  • Reasonable Apprehension: Must establish a reasonable belief of arrest on accusation of a non-bailable offense.
  • Antecedents: Court heavily weighs prior convictions of cognizable offenses.
  • Flight Risk & Interference: Undertaking that the applicant will not flee justice or tamper with prosecution witnesses.
Exclusion: Usually barred under special acts (e.g., SC/ST Act, UAPA) unless no prima facie case is made out.

The New Remand Window (Sec 187 BNSS)

Under the old CrPC, Police Custody (PC) could only be obtained in the first 15 days. The BNSS has fundamentally changed interrogation strategy:

For 60-Day Offenses: 15 days of PC can now be sought in blocks over the first 40 days.
For 90-Day Offenses: 15 days of PC can now be sought in blocks over the first 60 days.
